अवधारणा

भारतीय संविधान — दुनिया का सबसे लंबा लिखित संविधान — एक ऐसा दस्तावेज़ है जो बताता है कि देश कैसे चलेगा, किसके पास कौन-सी शक्ति होगी, और नागरिकों को क्या अधिकार मिलेंगे। इसे एक घर का नक्शा समझो: नक्शे में तय होता है कि कमरे कहाँ होंगे, दरवाज़े किस दिशा में खुलेंगे। उसी तरह संविधान तय करता है कि संसद क्या कर सकती है, राष्ट्रपति की भूमिका क्या है, और अगर सरकार नागरिक के अधिकारों का उल्लंघन करे तो नागरिक कहाँ जाएगा।

संविधान 26 जनवरी 1950 को लागू हुआ। इसे Constituent Assembly ने बनाया जिसकी drafting committee के अध्यक्ष डॉ. बी.आर. अंबेडकर थे। मूल संविधान में 395 Articles, 8 Schedules और एक Preamble था। अब तक 100 से अधिक संशोधन हो चुके हैं।

Bihar Police Constable परीक्षा में इस chapter से सीधे Articles-based प्रश्न आते हैं — "Article X किससे संबंधित है?" या "Y का उल्लेख किस Article में है?" यह rote-learning नहीं है। अगर तुम Articles को उनकी logic के साथ याद करो तो अनुमान लगाना बहुत आसान हो जाता है।

एक सरल analogy: संविधान को तीन परतों में देखो —

इन तीनों को समझ लो, Bihar Police के polity के 80% प्रश्न cover हो जाते हैं।


गहन विश्लेषण

Article 1 — भारत की परिभाषा

Article 1 कहता है: "India, that is Bharat, shall be a Union of States." यहाँ "Union" शब्द जानबूझकर चुना गया है। "Federation" नहीं लिखा क्योंकि भारतीय Union अविनाशी है — कोई राज्य अलग नहीं हो सकता। यह अमेरिकी federation से अलग concept है।

मौलिक अधिकार — Part III (Articles 12–35)

मूल रूप से 7 मौलिक अधिकार थे। 44वें संशोधन (1978) से संपत्ति का अधिकार (Article 31) हटाकर उसे legal right बना दिया गया। अब 6 मौलिक अधिकार हैं:

Article 17 — अस्पृश्यता उन्मूलन: यह Article किसी भी रूप में अस्पृश्यता के आचरण को दंडनीय अपराध घोषित करता है। परीक्षा में यह बार-बार आता है।

Article 32 — संवैधानिक उपचार का अधिकार: डॉ. अंबेडकर ने इसे "संविधान की आत्मा" कहा। क्यों? क्योंकि बाकी सभी मौलिक अधिकारों का कोई अर्थ नहीं अगर उन्हें लागू करवाने का रास्ता न हो। Article 32 नागरिक को सीधे Supreme Court जाने का अधिकार देता है। High Court में जाने के लिए Article 226 है।

नीति निदेशक तत्व — Part IV (Articles 36–51)

ये अधिकार नहीं हैं — ये सरकार के लिए निर्देश हैं। Court में इन्हें enforce नहीं करवाया जा सकता। लेकिन ये morally binding हैं। Ireland के संविधान से inspired।

राष्ट्रपति — Part V (Articles 52–78)

राज्यपाल — Part VI (Articles 153–167)

CAG — Article 148

Comptroller and Auditor General (CAG) की नियुक्ति Article 148 के तहत होती है। CAG केंद्र और राज्य सरकारों के सभी खर्चों और आय का स्वतंत्र audit करता है। यह executive के नियंत्रण से बाहर एक संवैधानिक संस्था है।

संसद की संरचना

संविधान संशोधन प्रक्रिया — Article 368

संशोधन तीन प्रकार से होते हैं:

  1. साधारण बहुमत — नए राज्य बनाना आदि।
  2. विशेष बहुमत (2/3 उपस्थित एवं मतदान + 50% कुल सदस्यता) — अधिकांश संशोधन।
  3. विशेष बहुमत + राज्यों की मंजूरी — संघीय ढाँचे से जुड़े बदलाव।

10वाँ संशोधन अधिनियम (1961): दादरा और नगर हवेली को भारत में Union Territory के रूप में शामिल किया। यह क्षेत्र पहले पुर्तगाल के अधीन था।

RTI Act 2005

सूचना का अधिकार अधिनियम 15 जून 2005 को अधिनियमित हुआ और 12 अक्टूबर 2005 से पूर्णतः लागू हुआ। यह नागरिकों को public authorities से जानकारी माँगने का कानूनी अधिकार देता है।


शॉर्टकट और युक्तियाँ

patternArticles की श्रृंखला — 'समता से शुरू, उपचार पर ख़त्म'

मौलिक अधिकारों के Articles एक तय क्रम में हैं: 14 (समानता) → 17 (अस्पृश्यता) → 19 (स्वतंत्रता) → 21 (जीवन का अधिकार) → 32 (उपचार)। इन्हें एक वाक्य में याद करो: "14 सम, 17 अस्पृश्य, 19 स्वतंत्र, 21 जीवन, 32 उपचार।" Pattern देखो: 14, 17, 19, 21, 32 — ये five key Articles हैं। एक बार यह sequence पक्की हो गई तो "Article 17 किससे संबंधित है?" जैसे प्रश्न 5 सेकंड में हल। बिना sequence के: 30-45 सेकंड सोचना पड़ता है।

patternCAG-Governor-CM का त्रिकोण

तीन important appointment Articles याद करने हैं: 148 (CAG), 155 (Governor), 164 (CM)। इन्हें एक pattern में देखो: तीनों में अंक बढ़ते जाते हैं और तीनों में नियुक्ति ऊपर से नीचे होती है — राष्ट्रपति → CAG (148), राष्ट्रपति → Governor (155), Governor → CM (164)। यह hierarchy trick तीन Articles को एक साथ lock कर देती है। अलग-अलग रटने में 3 बार पढ़ना पड़ता है, इस pattern से एक बार में काम हो जाता है।

elimination'Union of States' — Article 1 का keyword trap

परीक्षा में options होंगे: Federation of States / Union of States / Republic of States / Democratic States। "Federation" को तुरंत eliminate करो — यह शब्द भारतीय संविधान में कहीं नहीं है। Article 1 का exact phrase "Union of States" है। Elimination से: 4 options में से 3 गलत तुरंत हटते हैं, 8 सेकंड में उत्तर। Confusion में रहने पर 40 सेकंड लग सकते हैं।

patternRTI की दो तारीखें — 'June में जन्मा, October में चला'

RTI Act की दो dates परीक्षा में आती हैं: 15 June 2005 (enacted/passed) और 12 October 2005 (implemented/in force)। इन्हें याद करो: "जून में कानून बना, अक्टूबर में जनता तक पहुँचा।" जब question में "enacted" या "passed" आए → 15 June 2005। जब "came into force" या "implemented" आए → 12 October 2005। दोनों को mix करना सबसे common mistake है — यह trick step-count 0 कर देती है।

eliminationPro-tem Speaker की नियुक्ति — 'सबसे वरिष्ठ, राष्ट्रपति द्वारा'

Pro-tem Speaker को लेकर confusion होता है: क्या Speaker नियुक्त करता है? क्या Prime Minister? नहीं — राष्ट्रपति नियुक्त करते हैं, और conventionally Lok Sabha का सबसे वरिष्ठ सदस्य चुना जाता है। दो keywords lock करो: राष्ट्रपति + वरिष्ठतम। Options में "Prime Minister" या "Speaker" दिखे तो तुरंत eliminate। Standard confusion से बचने में 20 सेकंड बचते हैं।


तेज़-समाधान रूपरेखा

Bihar Police Constable में polity के प्रश्न दो types के होते हैं:

Type 1 — "Article X किससे संबंधित है?" → पहले तय करो: क्या यह मौलिक अधिकार (Articles 12–35) की range में है? → हाँ → ऊपर दिए pattern से match करो। → नहीं → क्या यह 100-200 range में है? → राष्ट्रपति / Vice President / संसद। → नहीं → क्या 150-170 range में है? → राज्यपाल / CM। → नहीं → 300+ range → Finance / CAG / Services।

Type 2 — "किस वर्ष / किस तिथि को X हुआ?" → RTI: June 2005 (enacted) या October 2005 (in force)। → 10th Amendment: 1961 (दादरा-नगर हवेली)। → संविधान लागू: 26 January 1950। → संविधान पारित: 26 November 1949।

Type 3 — "किसने X कहा / क्या कहलाता है?" → "संविधान की आत्मा" = Article 32 (अंबेडकर के शब्द)। → "भारत का प्रहरी" = CAG।

हर प्रश्न पर 30-40 सेकंड से ज़्यादा मत लगाओ। अगर Article number याद नहीं, तो elimination और common sense से option narrow करो।
