अवधारणा

भारतीय संविधान की असली ताक़त तीन स्तंभों में है — मूल अधिकार (Part III, Articles 12–35), नीति निदेशक तत्त्व (Part IV, Articles 36–51), और मौलिक कर्तव्य (Part IVA, Article 51A)। इन तीनों को अलग-अलग रटने की ज़रूरत नहीं; इनका आपसी सम्बन्ध समझो, तो CDS का हर Polity प्रश्न आसान हो जाएगा।

सरल सादृश्य: मान लो संविधान एक संगठन का चार्टर है।

याद रखने वाली core बात: मूल अधिकार नागरिक को राज्य के विरुद्ध सुरक्षा देते हैं — दो नागरिकों के बीच के विवाद में सीधे लागू नहीं होते (यह CDS में बार-बार पूछा जाता है)। DPSP सरकार की नीति को दिशा देते हैं, इसलिए इन्हें "positive obligations" कहते हैं। मौलिक कर्तव्य 42वें संविधान संशोधन (1976) द्वारा जोड़े गए थे — स्वर्ण सिंह समिति की सिफ़ारिश पर।

Article 14 बनाम Article 15 — यहाँ CDS में trap आता है:

Article 19 — छह स्वतंत्रताएँ (Seven नहीं — 44वें संशोधन के बाद संपत्ति का अधिकार हट गया):

  1. वाक् एवं अभिव्यक्ति की स्वतंत्रता
  2. शांतिपूर्वक सभा करने की स्वतंत्रता
  3. संगठन बनाने की स्वतंत्रता
  4. देश में कहीं भी आने-जाने की स्वतंत्रता
  5. देश के किसी भी भाग में निवास की स्वतंत्रता
  6. कोई भी व्यवसाय, व्यापार करने की स्वतंत्रता

Article 21 — सबसे विस्तृत Article: प्राण एवं दैहिक स्वतंत्रता का संरक्षण। न्यायालय ने इसके अंतर्गत कई अधिकार शामिल किए: शिक्षा का अधिकार (बाद में 21A बना), गोपनीयता का अधिकार (Puttaswamy केस 2017), स्वस्थ पर्यावरण का अधिकार।

Article 32 — "Heart and Soul": Dr. Ambedkar ने इसे संविधान की "आत्मा" कहा। Supreme Court को सीधे writ petition दाखिल करने का अधिकार। इसे suspend नहीं किया जा सकता सिवाय Article 359 के तहत Emergency में (और वह भी केवल Articles 20 और 21 को छोड़कर)।

नीति निदेशक तत्त्व — तीन वर्ग (Part IV)

DPSP को तीन categories में बाँटना परीक्षा में उपयोगी है:

मूल अधिकार बनाम DPSP का टकराव: यह CDS का recurring theme है।

मौलिक कर्तव्य — Article 51A

42वें संशोधन (1976) से जोड़े गए, मूल 10 कर्तव्य। 86वें संशोधन (2002) ने 11वाँ कर्तव्य जोड़ा — 6 से 14 वर्ष के बच्चों को शिक्षा का अवसर देना।

महत्त्वपूर्ण कर्तव्य जो CDS में पूछे जाते हैं:

Key: मौलिक कर्तव्य केवल नागरिकों पर लागू होते हैं, गैर-नागरिकों पर नहीं। और ये non-justiciable हैं — अर्थात् court इन्हें directly enforce नहीं कर सकती।


शॉर्टकट और युक्तियाँ

patternArticle 15 के Grounds — 'DRLSB' Formula

Article 15 में discrimination के निषिद्ध grounds याद करने के लिए: D-R-L-S-BDharma (Religion), Race (मूलवंश), Lingam (Caste — जाति), Sex (लिंग), Birth Place (जन्म-स्थान)। CDS 2026 में यही trap था — "only religion, race, caste" विकल्प गलत था क्योंकि Sex और Birth Place भी हैं। Standard approach: हर option एक-एक पढ़ो — 60 seconds। इस formula से: 10 seconds में पहचानो कि कौन-सा ground missing है।

patternDPSP की तीन Categories — 'SGL' Tag

DPSP articles को याद करते वक्त हर article पर tag लगाओ: S = Socialist (39, 41, 42, 43, 43A, 47), G = Gandhian (40, 43, 43B, 46, 47, 48, 48A), L = Liberal (44, 45, 49, 50, 51)। Note: कुछ articles overlap करते हैं (47 Gandhian भी है, Socialist भी)। जब exam में पूछे "निम्न में से कौन-सा Gandhian principle है" — Uniform Civil Code (44) को तुरंत eliminate करो, वह Liberal है। Standard approach: पूरी list recall करो — 45 seconds। SGL tag से: 8 seconds में category identify करो।

patternWrit Types — 'HMCP' Order

पाँचों writs: Habeas Corpus, Mandamus, Certiorari, Prohibition, Quo Warranto — "HM CP Q" (Home Ministry, Commissioner of Police, Quarters)। CDS में अक्सर पूछा जाता है "कौन-सी writ किसके लिए है" — Habeas Corpus = शरीर की स्वतंत्रता (detention के विरुद्ध); Quo Warranto = किसी public office पर अधिकार को चुनौती। ये दो सबसे ज़्यादा confuse होते हैं। 3 steps में eliminate करो बजाय सबकी परिभाषा याद करने के।

patternमौलिक कर्तव्य की संख्या — संशोधन से जोड़ो

42वाँ संशोधन → 10 कर्तव्य; 86वाँ संशोधन → 11वाँ कर्तव्य। Formula: 42+86 = 128, digits sum = 11 (कर्तव्यों की कुल संख्या)। यह coincidence है लेकिन याद रहता है। CDS में "कितने मौलिक कर्तव्य हैं" — option में 10 और 11 दोनों आते हैं। सही उत्तर 11 है। Standard recall: 15 seconds confusion। इस trick से: 3 seconds।

eliminationArticle 32 बनाम 226 — Court Level Identification

Article 32 = Supreme Court (writs के लिए), एक Fundamental Right है — suspend किया जा सकता है Emergency में (Article 359)। Article 226 = High Court (writs के लिए), Constitutional provision है — suspend नहीं होता। CDS में "कौन-सा article High Court को writ power देता है" के option में 32 और 226 दोनों आते हैं। Elimination rule: 32 = Supreme, 226 = High — "SC पहले, HC बाद में" — numbers भी इसी क्रम में हैं। 2-step elimination: 5 seconds।


तेज़-समाधान रूपरेखा

CDS के Polity section में मूल अधिकार से प्रश्न आने पर इस decision tree को follow करो:

Step 1 — Topic identify करो: क्या प्रश्न किसी specific Article number के बारे में है? → सीधे याद करो।

Step 2 — "Negative + Positive" test: मूल अधिकार "negative obligations" हैं (राज्य यह नहीं करेगा), DPSP "positive obligations" हैं (सरकार यह करेगी)। अगर प्रश्न में "सरकार का दायित्व" या "नीति का लक्ष्य" हो → DPSP।

Step 3 — Enforceability check: अगर option में "court में enforce होता है" आए → मूल अधिकार। "Moral obligation" या "non-justiciable" आए → DPSP।

Step 4 — "Citizen Only" test: मौलिक कर्तव्य और Article 15/16/19 — केवल नागरिकों पर। Article 14 और 21 — सभी व्यक्तियों पर (नागरिक और गैर-नागरिक दोनों)।

Step 5 — Amendment trap: 42वाँ संशोधन = DPSP को priority दी (Article 31C), मौलिक कर्तव्य जोड़े; 44वाँ संशोधन = संपत्ति का अधिकार हटाया Part III से; 86वाँ संशोधन = 11वाँ कर्तव्य + Article 21A।

यह पाँच-step framework किसी भी Part III/IV प्रश्न को 30 seconds में solve करने के लिए पर्याप्त है।

Article 16 provides equality of opportunity in matters of public employment (option a correct). Article 25 guarantees freedom of conscience and the free profession, practice and propagation of religion (option b correct). Fundamental Rights are legally enforceable through writs under Article 32 (option d correct). However, Article 15 prohibits discrimination on grounds of religion, race, caste, SEX and PLACE OF BIRTH — not only on the grounds of religion, race and caste. Hence statement (c) is incorrect and is the answer.
