Union Budget / Parliamentary Procedure — UPSC Mains Model Answer

Question: Vote on Account — constitutional basis, procedural significance, and limitations in parliamentary financial procedure

Introduction

The Vote on Account is a critical parliamentary instrument that ensures continuity of government expenditure when the full Union Budget cannot be passed before the commencement of a new financial year.

Body

1. Constitutional and Procedural Basis

Under Article 116 of the Constitution, the Lok Sabha may make a grant in advance in respect of estimated expenditure for a part of a financial year. This provision allows the executive to draw funds from the Consolidated Fund of India without waiting for the full Appropriation Act to be enacted. It is a practical safeguard against administrative paralysis at the start of a financial year.

2. Distinction from a Money Bill

A Vote on Account is not treated as a Money Bill under Article 110 of the Constitution. It is passed as a standalone grant by the Lok Sabha through a simplified procedure, without the full scrutiny that accompanies the regular budget. The Rajya Sabha has no power to vote on it, but this is by parliamentary convention rather than Money Bill classification.

3. Conventional Quantum Limit

By established parliamentary convention, a Vote on Account is typically limited to one-sixth of the total estimated expenditure for the year, covering approximately two months. However, this is a convention, not a constitutional mandate; in election years or exceptional circumstances, the government may seek a larger grant.

4. Governance Significance

The instrument is particularly relevant in election years when an outgoing government presents an interim budget. It prevents policy overreach by restricting new expenditure commitments, preserving fiscal neutrality until a new government presents its full budget.

Conclusion

The Vote on Account balances administrative continuity with parliamentary accountability. Strengthening transparency around its use — especially in election years — remains essential to uphold the legislature's primacy in financial governance.
