3. Floor Test — अंतिम संवैधानिक जाँच

राष्ट्रपति चाहे जिसे भी आमंत्रित करें, नियुक्त प्रधानमंत्री को उचित समय-सीमा के भीतर Lok Sabha के पटल पर बहुमत सिद्ध करना अनिवार्य है। यह संवैधानिक अपेक्षा निर्णायक जाँच के रूप में कार्य करती है, जिससे राष्ट्रपति का प्रारंभिक चयन महत्त्वपूर्ण तो होता है, किंतु अंतिम नहीं।

4. विवेक निर्देशित है, असीमित नहीं

सामूहिक उत्तरदायित्व, Articles 74 और 75 की भावना तथा सरकार गठन से संबंधित न्यायिक टिप्पणियाँ — ये सभी पुष्टि करते हैं कि राष्ट्रपति का विवेक एक मानक ढाँचे के भीतर संचालित होता है। पूर्णतः असीमित विवेक संसदीय लोकतंत्र की मूल भावना को ही क्षीण कर देगा।

निष्कर्ष

त्रिशंकु संसद में राष्ट्रपति की भूमिका संवैधानिक संरक्षक की है, राजनीतिक प्राथमिकता के निर्णायक की नहीं। परंपरा, पूर्व-निर्णयों और Floor Test पर आधारित निर्देशित विवेक ही लोकतांत्रिक वैधता और संवैधानिक औचित्य दोनों को सुरक्षित रखता है।
